Minimum marriage age in India

The central marriage provisions covered here set the age at 21 for the male party and 18 for the female party. These thresholds appear in section 5(iii) of the Hindu Marriage Act and section 4(c) of the Special Marriage Act. The Prohibition of Child Marriage Act defines a child as a male below 21 or a female below 18. [S11, S12, S13]

For a proposed wedding date, calculate each person's age on that date and check the legal provision that applies. The age gap between the couple does not tell you whether both meet the required age.

Is the marriage age for women 18 or 21

The provisions cited here use 18 for the female party. A proposal to raise the age should not be treated as a law already in force. Check the applicable law rather than relying on a headline about a proposed change. [S11, S12]

ProvisionMale partyFemale party
Hindu Marriage Act section 5(iii)21 years18 years
Special Marriage Act section 4(c)21 years18 years

These are the age conditions in those provisions. A valid marriage also depends on other conditions and the procedure that applies to the couple.

Calculate both ages on the wedding date

Use the same proposed date for both people. If you use today's date for one person and the wedding date for the other, you will not be comparing their ages at the same point.

For a proposed marriage on 1 October 2026:

PersonDate of birthCalendar age on the proposed date
Male party10 December 200520 years 9 months 21 days
Female party20 January 200818 years 8 months 11 days

The male party has not reached his twenty-first birthday, while the female party has passed her eighteenth. Both age conditions must be checked separately; one person's age cannot make up for the other's shortfall.

Use the full recorded birth dates. A birth year alone cannot tell you whether the required birthday has arrived, especially when the proposed date is close to it.

Finding the later of the two required birthdays

For ordinary birthday planning, find each required birthday and take the later date. In this example, the female party turns 18 on 20 January 2026 and the male party turns 21 on 10 December 2026. The later birthday milestone is 10 December 2026.

That gives you a calendar comparison. It does not establish the earliest legally permitted ceremony or registration date. The applicable procedure and the legal rule for the exact day of reaching an age still need to be checked, particularly near a one-day boundary.

A date well after both milestones avoids that birthday shortfall. The other legal and procedural requirements still apply.

Why marriage and registration age rules can differ

“Registration” can refer to different legal routes. Section 15(d) of the Special Marriage Act, which concerns registration of marriages celebrated in other forms, requires both parties to have completed 21 at the time of registration. That differs from section 4, which covers solemnisation under the Act. [S12]

Check which route you intend to use before applying an age rule. A ceremony date, a registration application date and the date a certificate is issued are not necessarily the same date.

If you have seen both 18 and 21 mentioned in registration information, look at the provision being discussed. That context explains which requirement applies.

Can your birth date predict your wedding date

A date of birth can tell you your age on a proposed date. It cannot predict your wedding date, decide the ideal age for you to marry or assess compatibility.

If you simply want to compare two birth dates, use the age difference calculator. An age gap and a marriage-age eligibility check answer different questions.

Frequently asked questions

Can two people aged 18 marry under these laws

The cited marriage provisions require 21 for the male party and 18 for the female party. If both are 18, the male party does not meet the stated age threshold. [S11, S12]

Can parental consent reduce the required marriage age

Do not treat parental consent as an age relaxation under these provisions. The Prohibition of Child Marriage Act addresses marriages involving a person below its defined age threshold. [S13]

Should I use my age on the wedding date

Use the proposed wedding date to find both ages at the marriage. A separate registration provision may require age to be checked on another specified date.

Is meeting the age requirement enough for marriage registration

No. You still need to check the registration route, required documents and other statutory conditions with the marriage authority. The calculator answers the age question from the dates entered.
