Legal marriage age in India for men and women

The minimum legal age to marry is 18 for a woman and 21 for a man, under the Prohibition of Child Marriage Act 2006, the Hindu Marriage Act 1955 and the Special Marriage Act 1954. A marriage below these ages is treated as a child marriage and is voidable at the option of the person who was a child at the time.

About that 2021 proposal: the Prohibition of Child Marriage (Amendment) Bill 2021 wanted to raise the woman’s age to 21, but it lapsed with the 17th Lok Sabha in 2024 and never became law. Himachal Pradesh’s Assembly has passed its own 2024 amendment to raise the woman’s age to 21 in the State, but that one still needs the President’s assent under Article 254 to take effect, and until that comes through it is not yet in force.
